Chief Justice John Roberts announced Thomas’ absence, saying that his colleague would still participate in the day’s cases, based on the briefs and transcripts of the arguments. The court sometimes, but not always, says when a justice is out sick.
What’s special about this is that he was hospitalized in 2022 with an infection, causing him to miss several sessions, but he did take part in those cases. (Sounded like COVID to me.)
Today’s cases that he missed involve (a) a corruption case involving a mayor in Indiana and (b) what constitutes malicious prosecution under the 4th Amendment.
